Sand ’N Sea will work hard to make sure that everything in your vacation property works properly, that it is clean upon your arrival, and that you have everything you need. Be sure to let us know if we can help with anything!

For any emergencies that need our attention on weekends, holidays, and nights, Sand ’N Sea vacation Guests will be given our after-hours emergency telephone number at check in.

RESERVATIONS AND PAYMENTS

It’s easy to book your vacation rental. You can browse our website at sandnsea.com at any time of the day, on any day of the week, for photographs, floor plans, and maps, and then just book your reservation online.

You can also reserve a property by calling our toll-free line at 800.880.2554.

Or, we’ll be happy to make your reservations in person. Just visit our Galveston office at 13706 FM 3005, at the entrance to Pirates Beach, on any workday between 9:00 a.m. and 5:00 p.m.

Please designate one person in your party to be responsible for payments, property damages, and all responsibilities spelled out herein and in the rental contract; this person's primary residence address and e-mail address will be used for all notices and correspondence.

After you make your reservation, we'll e-mail you a Rental Contract and Guest Registration forms. Your reservation is not confirmed until we receive these signed documents and an advance payment.

The rental fee includes all applicable taxes and fees, as well as a non-refundable $50 reservation fee; travel insurance is optional.  The advance payment is approximately 50% of the rental fee, plus the reservation fee and optional Travel Insurance premium.

Advance payments must be paid by check. Sorry, we do not accept credit cards for advance payments.

The advance payment is due, along with your signed Rental Contract and completed Guest Registration forms, within seven days of making the reservation.

The remaining balance is due at check-in and may be paid by credit card (Visa or MasterCard accepted), money order, or cash. Checks are not honored at check-in.

Please note: If your paperwork and advance payment are not received within seven days of booking, your reservation is automatically cancelled. The returned-check fee is $50.

RESERVATIONS MADE FEWER THAN 30 DAYS BEFORE ARRIVAL

If your reservation is made fewer than 30 days before check-in, it must be paid in full – either by using a credit card or in person, at our office. Checks are not accepted for reservations made fewer than 30 days before arrival.

HOLIDAYS AND PEAK SEASON RENTALS

During the summer Peak Season, we require a minimum seven-night stay. Check-in days are either Friday or Monday, depending on the property, from 4:00 p.m. – 6:00 p.m.

For rentals of less than seven nights during Peak Season, ask a Rental Agent or check the “Summer Weekends” button on our website.  “Summer Weekend” properties will be posted mid-May. 

The following holidays require a three-night minimum stay: Memorial Day, Labor Day, Christmas, New Year’s Day.

Spring Break (March 7 – 23, 2008) requires a seven-night minimum.

There is a four-night minimum stay for Thanksgiving weekend.

Holiday rental rates have a surcharge:

  • Thanksgiving, Christmas, and New Year’s - 30% over Low Season rates
  • July 4th - 5% over Peak Season rates
  • Labor Day - 20% over Mid-Season rates

CHECK-IN DAYS

With the exception of holidays and Peak Season rentals, Guests may arrive on any day.

During the summer Peak Season, check-in days are either Friday or Monday, depending on the property.

Only the reservation holder is allowed to check in and receive keys. Sorry, no exceptions.

ARRIVALS

Peak season check-in time for all Guests is at 4:00 p.m.; this allows our housekeeping staff time to prepare your vacation property properly.

Please don't pressure our staff to let you into your property before 4:00 p.m. There's plenty to do while you wait – enjoy our beaches, tour the historical district, or visit the Strand and shop. Sometimes, it may be necessary to delay check-in beyond 4:00 p.m., but that is extremely rare.

Under no circumstances should you go directly to or enter your vacation property before check-in.

During Peak Season and holidays, our office hours are extended to 6:00 p.m. on check-in days. Please plan to arrive by then.

Sorry, but we can't leave keys out for late arrivals, and we make no exceptions (security for you and the property owner!) If you are caught in traffic, be sure to call our office and let us know so that we can plan accordingly.

During the Low Season and the Mid-Season, check-in days and arrival times may be more flexible, based upon availability. Check with our office before you arrive to see if an early check-in is possible.

Only the reservation holder is allowed to check in and receive keys. Sorry, no exceptions.

DEPARTURES

Check-out time is 10:00 a.m. Drop the keys at our office and let us know how much fun you had during your stay! And don't forget to make your reservation for next year! Properties are available for advance reservations to departing Guests first; advance reservations may be made up to one year in advance.

During the Low Season and Mid-Season and for two-night rentals, check-out days and departure times may be more flexible, based upon availability. Check with our office before your departure to see if late check-out is possible.

CANCELLATIONS, REFUNDS & SUBSTITUTIONS

We understand that there can be unforeseen emergencies that could cause you to cancel your reservation. We'll try to work with you to resolve the situation. However, please note our cancellation policy:

  • Refunds are not given for rain, overcast skies, or early departures.
  • Refunds are not given for storms, hurricanes, or mandatory evacuations during hurricane or severe storm threats. We recommend that you purchase Trip Cancellation and Travel Interruption insurance – don’t forgetHurricane Rita and the mandatory evacuation in 2005! Information about travel insurance will be e-mailed to you, along with your Rental Contract, Guest Registration forms, and GARM Guests’ Agreement.Click here for insurance information.
  • If circumstances require, Sand ’N Sea reserves the right to substitute a comparable beach property.If comparable accommodations are not available, then Guests may choose from available properties at the published rate or request a refund.
  • Power, cable, and telephone outages occur occasionally on Galveston Island; they are out of our control.We will report the outages; however, no refunds will be given due to these outages.
  • New construction is a part of life on West Galveston Island. If your property is near construction, we will do our best to talk with the contractors, but please realize that this situation is beyond our control. Sorry, no refunds or moves will be made under these circumstances.
  • There is no refund for appliance, plumbing, or mechanical failure; utility failure; or circumstances beyond our control.
  • Once your reservation is confirmed (when the advance payment, signed Rental Contract, and completed Guest Registration forms and the GARM Guests’ Agreement are received), any cancellations, changes of dates, or switching of properties will invoke the cancellation policy.
  • Cancellations 30 or more days before date of arrival: A full refund will be issued, minus the Cancellation Fee ($50), Reservation Fee ($50), and Travel Insurance premium, if taken.
  • Cancellations fewer than 30 days before date of arrival: A full refund will be issued, minus the Cancellation Fee ($50), Reservation Fee ($50), and Travel Insurance premium, if taken, only if Sand ’N Sea is able to re-rent the property for the same time period.
  • Refund checks will be issued 30 days after cancellation.
OCCUPANCY POLICY

We work very hard to maintain a quiet atmosphere for the enjoyment of our Guests and our West Galveston neighbors. We will rent only to family groups and responsible adults older than 25.

Any use of the property for purposes other than family vacations must be addressed at the time of the reservation. Occasions such as parties, weddings, receptions, company gatherings, or picnics are not allowed.

We do not rent to prom groups, school or graduation groups, fraternities or sororities, or youth groups with or without adult supervision. Adults cannot rent properties on behalf of underage guests.

In certain circumstances, a refundable security deposit will be required.

Our brochure and website indicate the maximum number of Guests allowed in each property. All Guests and their vehicles must be listed on the Guest Registration form. Exceptions are made only for infants.

All of our properties are non-smoking.

Guests must comply with these occupancy and Rental Policies and all subdivision restrictions. Violation of these policies may result in eviction and forfeiture of all monies.

PETS

Several properties are pet-friendly and allow two small dogs.

Be sure to ask about these properties when you speak with the Rental Agent. You can also search for pet-friendly properties on our website.

There is a non-refundable pet fee of $100 per animal.

PARKING

To help preserve the quality of life on West Galveston Island, subdivisions limit the number of cars which can be parked at properties. Most subdivisions allow four cars at each property. Parking is not allowed on streets, lawn areas, or dunes.

RVs and campers are not permitted on the grounds of any property at any time.

Check with your Rental Agent about parking restrictions for your specific vacation property.

CHOOSING YOUR VACATION RENTAL

Our rental properties are individually owned and reflect the taste of the owners. They vary in size, décor, and amenities; pictures and floor plans are on our website.

For rentals of seven nights or more, we'll be happy to show you up to three properties as long as they're not occupied and a Rental Agent is available to accompany you. Appointments are required.

Please note: Prospective Guests will not be given keys to view the properties alone.

HOUSE LOCATIONS

Locations of our properties vary. Our Rental Agents can answer specific questions regarding views or beach access.

  • Beachfront: There is nothing between the property and the Gulf, except a dune, a dune crossover, or, in Pirates Beach, a sandsock.
  • Beachside: The property is on the Gulf side (south) of FM 3005. You may or may not have a view of the Gulf. Your walk to the beach could be as little as 20 yards or up to four blocks, depending upon the location of the property.
  • Canal/Bay:The property is located either on a canal or on Galveston Bay, north of FM 3005.
  • North of the Road/Dryland:The property is on a dry lot, north of FM 3005.
HOUSES and AMENITIES

All of our properties feature standard household items. These include a telephone, cable or satellite TV, central air/heat, microwave, coffee maker, toaster, pots and pans, dishes, utensils, glassware, and a charcoal BBQ grill.

Unique and specific equipment and/or amenities for each property are listed in the individual property descriptions located in the brochure and on our website. Hot tubs, additional TVs, VCRs, DVDs, porch furniture, dock access, recreational games, equipment, and similar items are furnished as a courtesy by the owner and are not guaranteed by Sand ’N Sea.

All equipment in each property should be in working order when you check in. Please report any inoperative equipment or problems to the office immediately. You can expect a courteous and professional attitude to problem solving, and we will make every reasonable effort to resolve the problem promptly. Please understand that emergencies take precedence.

However, under no circumstances will there be a reduction of rent for any mechanical failure of air conditioners, dishwashers, refrigerators, washers, dryers, cable or satellite TV, Internet access, televisions, VCRs, DVD players, hot tubs, swimming pools, or any other appliances or amenities.

A charcoal grill is provided at each property.Grills must be used outdoors on the ground level. Grilling on decks is a fire hazard and is strictly forbidden. 

High chairs, cribs, and rollaway beds are available through local vendors. We’ll be happy to refer you to them; just call our office for details.

LINENS

Each property will be supplied with the appropriate amount of sheets and towels to suit the property’s capacity, so everything will be ready for you to kick off your shoes and relax!

Standard beds will be made up with linens, blankets, and a bedspread.

Due to insurance regulations, we cannot make up any bunk beds, sofa sleepers, or trundle beds for you; however, plenty of linens will be supplied for these beds. 

Please be sure that all linens remain in the property when you leave.

  • Cleaning supplies: Dishwasher soap, dishwashing liquid
  • Non-perishable food items: Condiments, sugar, etc. 
  • Beach supplies: Cooler, hats, beach umbrella, beach chairs, beach towels, sunblock
  • Charcoal and lighter fluid for grills
  • Personal supplies: Bath soap, shampoo, etc.

SWIMMING POOLS, GOLF, & TENNIS

GARM GUESTS' AGREEMENT

Sand ’N Sea is a founding member of the Galveston Association of Rental Managers (GARM).

All GARM members require their guests to sign a Guests’ Agreement which outlines all local, subdivision, and property-management-company rules.

The GARM Guests’ Agreement will be e-mailed to you, along with your Rental Contract, Guest Registration forms, and insurance information.

PROPERTY DAMAGES

Guests will not be responsible for the first $1,000 of accidental damage to the property or its contents caused by the Guest, the Guest's family, or invited guests.

However, the Guest will be responsible for any such accidental damages in excess of $1,000 and for all damage or loss to the vacation property and its contents that is not the result of accidental damage.

Accidental damage is defined as unintentional damage from unforeseen accidents; it does not include loss or damage resulting from intentional acts, gross negligence, willful and wanton conduct, or damage or loss caused by a pet or other animal brought onto the premises by the Guest, the Guest's family, or invited guests.

If damage occurs during your stay, be sure to call the office right away so that we can take care of it for you.

Non-compliance with the Rental Contract, these rental policies, occupancy rules, subdivision restrictions, GARM Guests’ Agreement, or pet restrictions – as well as any illegal activity or conduct creating a nuisance, waste, hazard, or disturbance – are each grounds for immediate eviction without refund.

MAINTENANCE AND EMERGENCIES

We have a terrific maintenance staff. They are available seven days a week to take care of everything from routine maintenance to plumbing problems. If you need something, we'd like you to call us immediately.

You will receive our after-hours emergency telephone number at check-in. For non-emergency issues, please call the office during office hours.

HURRICANE POLICY, MANDATORY EVACUATIONS & TRAVEL INSURANCE

Sand ’N Sea Properties does not offer refunds in the event of a mandatory hurricane evacuation.

We strongly recommend that Guests purchase travel insurance for stays occurring during hurricane season (June 1 through November 30.) Please see the “Trip Cancellation and Travel Interruption Insurance” section above.

OFFICIAL NOTIFICATION: By signing the Rental Contract, each Guest acknowledges being offered insurance to compensate the Guest for losses or damages resulting from loss of use of the property due to a mandatory evacuation order. If the Guest refuses said offer to purchase travel insurance, the Guest shall not be entitled to a refund of monies paid.The Guest also agrees to comply with all orders of evacuation.

 

Once you have entered into a contract to rent a property, you are binding yourself to that property for that time. There should be no expectation of compensation or relocation because you don't like the property or because something in the property isn't working to your satisfaction.

Unlike a hotel, we cannot relocate you without specific authorization from the home owner. As previously stated, we will make every effort to correct any malfunctions or problems encountered, but no refunds should be expected.

The owner of Sand ’N Sea Properties reserves the right to cancel a confirmed reservation (with good reason) at any time prior to the Guest’s taking occupancy of the property. In the event this should occur, Sand ’N Sea Properties will refund all monies on account.

 

TRAVEL INSURANCE

Things happen! Unforeseen circumstances such as unexpected illnesses, deaths, or hurricanes do occur.

We want our Guests to be protected, so we offer Travel Guard Trip Cancellation and Travel Interruption Insurance. This insurance is optional, but we recommend it so that you may be financially reimbursed in case of unforeseen events.

We strongly urge all Guests to purchase travel insurance for stays occurring during hurricane season (June 1 through November 30.)

All Guests will receive a brochure outlining the travel insurance when they’re sent the Rental Contract, Guest Registration forms, and GARM Guests’ Agreement.If you choose to buy travel insurance, you must purchase it when you make your initial rental payment.

We charge a $25 Advance Reservation Fee. 

Properties are available for advance reservations to departing Guests first; advance reservations may be made up to one year in advance.

LOST & FOUND

Sand ’N Sea is not responsible for items left behind in properties. We will attempt to locate lost items, but we can’t guarantee that we will find them. Please check your property carefully before leaving.

There is a $25 fee to search for and/or retrieve lost items, plus shipping costs.These amounts will be either charged to your credit card or paid by money order.

Retrieved items are kept at the office for 30 days; after 30 days, the items are donated to charity.

Sand ’N Sea's GuestAdvantage™ plan is simple: Each time you book a house online, you will earn points towards a free weekend (2 nights) vacation at a Sand ’N Sea property!

  • Each night in a Sand ’N Sea beach house earns 180 points.
  • Once you've accumulated 5,000 points, you will receive a free two-night stay in one of Sand ’N Sea's West Galveston vacation homes.

Special terms and conditions apply:

  • The GuestAdvantage™ member receives a two-night stay at a Sand ’N Sea property for a maximum of six Guests.
  • The award must be used within 12 months of the date when the award points become available to use.
  • Sand ’N Sea Properties reserves the right to choose an appropriate property and to make last-minute substitutions if necessary.
  • Dates of stay are any two nights of the week, excluding all holidays and the summer Peak Season. (See current Sand ’N Sea materials for holiday and Peak Season dates.)
  • Check-in time is between 3:00 p.m. and 5:00 p.m., and check-out time is 10:00 a.m. on the day of departure.
  • All applicable taxes and fees are included.
  • Linens and towels are included, and standard beds are made for your arrival.
  • No pets are allowed.
  • No smoking is allowed at the property.
  • Recipient must complete and sign the Sand ’N Sea Properties Guest Registration form, and agree to and sign the Terms and Conditions of the Sand ’N Sea Properties Rental Policy and the Galveston Association of Rental Managers (GARM) Guests’ Agreement.
  • Guest Advantage points are not awarded for Winter Texan stays.
  • This offer is available only to the registered GuestAdvantage™ member and is not transferable.

MISCELLANEOUS

Sand ’N Sea Properties, Inc., a Texas corporation d/b/a Sand ’N Sea Properties, is acting solely in the capacity as management agent and is not the "Landlord" for purposes of Chapter 92 of the Texas Property Code with respect to the rental of any vacation home. Each rental of a vacation home is at will and on a day-to-day basis, and each Guest agrees that only one days' notice to vacate is required pursuant to Chapter 24 of the Texas Property Code, and that no notice to terminate the Guest's tenancy with respect to any vacation home is required pursuant to Chapter 91 of the Texas Property Code. To the fullest extent allowed by law, each Guest waives any notice or other requirement that a "Landlord" is required to provide to a "Tenant" under Chapter 92 of the Texas Property Code. To be effective, any notice or request for disclosure by the Guest with respect to the rental of the vacation home or otherwise with respect to these matters must be in writing and delivered to Sand ’N Sea Pirates Beach at its office address.

The rental of each vacation home is made with no implied warranties of merchantability, habitability, fitness for a particular purpose, or any other kind and each vacation home is rented in its present condition, "as is – with all faults."

Subject to the prior provisions in these Rental Policies regarding accidental damage to the house and its contents, Guest shall indemnify, defend, and hold harmless Sand ’N Sea Pirates Beach and the owner of the house, their employees, agents, and representatives, and all of their successors and assigns (together, the "covered parties), from and against any and all losses, claims, damages, liabilities, causes of action, costs, and expenses (including reasonable attorneys' fees) for personal injury or property damage arising from or in connection with Guest’s right of access to the house and property, occupation or condition of the house and property, and/or use of the house and property, and regardless of any negligence or strict liability on the part of any of the covered parties and regardless of the form of claim whether at common law, strict liability, negligence, or under any statute or regulation.

Sand ’N Sea Pirates Beach does not discriminate with respect to the rental of vacation homes based on race, color, religion, sex, familial status, national origin or disability.

These Rental Policies and the rental contract constitute the entire agreement regarding the rental of the vacation home and, unless incorporated herein and therein, there are no other oral representations, warranties, agreements, or promises pertaining to the rental of the vacation home. All these matters shall be construed in accordance with the laws of the State of Texas, and exclusive venue with respect thereto is in the State Courts of Galveston County, Texas.

The terms and provisions of these Rental Policies may be revised and amended at any time, and from time to time, by Sand ’N Sea Pirates Beach, and if so revised and amended and furnished to the Guest prior to the Guest's occupancy of the vacation home, they shall for all purposes be considered effective and binding upon the Guest, as so revised and amended.

Sand ’N Sea rental guidelines change from time to time. The most current version is found on our website, www.sandnsea.com, and is also provided to you along with your Rental Contract.
